Permit Extension
Work permits are given on a one year basis for foreigners in Turkey who are applying for the first time. However, applications for extension of work permits may be made for two years and the workplace of the foreigner must meet certain criteria. For foreigners who have completed two years, a work permit may be extended for three years.

Work permit extension (for Companies)
- In order for one foreign employee, five insured Turkish personnel must have been employed within the past year.
- The foreigner’s salary must be paid in full through the bank.
- The foreigner’s SSI payments must be done in full with no incurred debts.
- The employer should not have tax debt.
- According to the title of the foreigner, the company must have its activities and turnover. For example, if the company works as a foreign salesman, the company should have foreign sales.
- The foreigner must not reside outside of Turkey for a total of six months in a year.
- The foreigner must not be complicit in any crime during the time he/she is residing in Turkey.
- The number of Turkish employees that could do the job of the foreigner should not have increased. For instance, if a foreigner is working as an English Teacher and there are Turkish English Teachers looking for employment through ISKUR, the permit will not be extended and you will be requested to hire the Turkish Personnel.
- Application for extension of the work permit may be made at the end of the work permit at the end of fifty-nine days (59) and in any case, should be made before the last day. If the work permit extension is not carried out on time, the foreigner is sent to his/her own country and a re-application is made to the Turkish embassy again as in the first application.
- For a foreigner whose work permit is to be extended, it is also obligatory to have 5 insured Turkish personnel at the workplace and for work permit extension applications.
Work permit extension (Home services)
- If the foreigner is working in care, the person being cared for should be alive.
- If the foreigner is employed in child care, the child must be under fifteen (15) years of age.
- SSI payments of foreigners should be made regularly.
- The foreigner must not reside outside of Turkey for a total of six months in a year.
- The foreigner must not be complicit in any crime during the time he/she is residing in Turkey.
Work permit extension (for private education institutions)
- In the first application of the institution, the balance of the number of students, teachers and foreigners should be intact.
- The number of students of the institution should be increased in order to apply for the work permit extension of foreigners working with public relations and guest relations staff title in educational institutions.
- In order for one foreign employee, five insured Turkish personnel must have been employed within the past year.

Residence Permit Application
Residence Permit Application Procedures

There are some rights and obligations of the foreign person in the implementation of the rules of international law and national law in our country. One of the most important grounds for establishing a legal link between the foreign person and our country is the residence permit.
It will soon be possible to obtain the residence permit applications from the Turkish consulates in the country where the foreigners are citizens or legally resident, and this situation will be announced. Until this stage, the residence permit applications for foreigners are taken from the Provincial Directorate of Migration.
Foreigners who have a valid residence permit will be able to enter or leave the country free of visa permit.
The foreigner may extend a residence permit if the necessary conditions are still met when the permit expires or to provide the necessary conditions for another residence permit, the foreign person is allowed time to stay in Turkey without the need to leave the country of residence by going to the provincial governor.
In the application for the residence permit application, according to the application of Law No. 6458 on Foreigners and International Protection, the accompaniment application has been abolished and the application and permit of each foreigner will be arranged separately.
Applications for a residence permit may be made by the foreigner in person or through a legal representative or a lawyer of the foreigner. However, in accordance with the initiative given to the administrative unit in this regard, the applicant may request the presence of a foreigner during the application.

Types of Residence Permit
Foreigners who have a strong suspicion of being or could be a victim of human trafficking shall be granted a thirty-day residence permit by the governors. In the granting of this permit, the conditions required in other residence permits are not sought. The permits of trafficking victims may be extended for a maximum of six months, but these periods shall not exceed three years. In the event that it is determined that the foreigners with this residence permit have reconnected with the perpetrators of the crime on their own initiative, the residence permits shall be cancelled.
Family Residence Permit
Family residence permit, the sponsor in Turkey (Turkish citizens, within the scope of Article 28 of Law No. 5901, of the refugees and subsidiary protection status of the owners have a residence permit); foreign spouse, he or his wife, or child, or adult who is in need of care. The mentioned supporter must have valid health insurance for all family members, have an income to provide no less than one third of the minimum wage, must not have committed any crimes against the family in the last five years proven by a criminal record, have resided in Turkey for at least one year and have a registered address in the system. If the sponsor has more than one wife, only one of the spouses and the children can all be allowed. The duration of the family residence permit is granted for a maximum period of two years at a time and cannot exceed the duration of the residence permit of the sponsor. Children under 18 have the right to education with the family residence permit in Turkey in primary and secondary education institutions. Those who have left this permit for at least three years can turn to a short term residence permit upon their 18th birthday. Divorce may be granted if it is a short-term residence for at least three years, it has become the family residence permit in Turkey but foreign spouses in domestic violence because of who proved to be a victim by a court decision does not apply to this requirement. The disappearance requirements set by the article 35 of the relevant law from residing in Turkey with this permission, the total face of marriage and eighty days who are abroad will be cancelled residence permits if it is determined by the governor it is made for permission to mere residence in the past year.
Humane Residence Permit
The humane residence permit is granted and extended by the governorships, with the approval of the Ministry and with a maximum period of one year. The conditions for granting other residence permits are not sought inhumane residence permits, and the governor’s office initiates humane residence procedures if:
- In the case of the best interests of the child,
- Rights in Turkey ban on entry or deportation decision was taken even though, cannot be built in the foreigner’s exit from Turkey or of leaving Turkey were not possible or reasonable,
- In cases where it is not possible to expel the foreigner (Regulated in Article 55. of the relevant Law)
- In the process of continuing the applicant’s return to the first asylum country or a safe third country,
- Due to emergency reasons or national interests of protecting public order and public safety in terms of entry to Turkey and foreigners should be allowed to remain in Turkey, due to circumstances that preclude granting a residence permit in the absence of the possibility of getting one of the other residence permits,
- In exceptional cases.
Foreigners who have received a humane residence permit must register to the address registration system within twenty business days after the date of the permit. In addition, persons who have a humane residence permit may apply for one of the other residence permits, with the exception of a long-term residence permit, within the period of their authorisation. If the conditions that require the permission of the Ministry to be approved by the Ministry are cancelled, the Humane residence permit shall be annulled and not extended by the governors.
Short Term Residence Permit
In order to be able to arrange a short term residence permit, a number of conditions are sought in the foreigner. They are to submit information and documents related to the purpose of the foreigners stay in Turkey, shall not be in the list of foreigners not allowed in Turkey specified in Article 7 of the relevant Law, shall have housing conditions in appropriate safety and general health, is required to be citizen or legal residence authorised in the country, to provide proof of the criminal record, provide address information to reside in Turkey to the authorities.
Short-term residence permits are listed below:
- Foreigners who will come for scientific research,
- Foreigners immovable property located in Turkey,
- Foreigners who will establish business or business connection,
- Foreigners who will participate in the in-service training program,
- Agreements signed by the Republic of Turkey or foreigners who are coming for educational or similar purposes in the framework of student exchange programs,
- Foreigners who will remain for tourism purposes, (Foreigners who declare that they will stay for tourism purposes, first of all, how they will provide their livelihood and clarify where they will reside.)Foreigners who will be treated provided that they do not carry one of the diseases considered as a threat to public health,
- Depending on the judicial or administrative authorities or decisions of the foreign demand should remain in Turkey
- Foreigners who will be granted a short term residence permit if they lose the conditions of family residence permit,
- Foreigners who will participate in Turkish learning courses. (These foreigners can be granted a residence permit up to two times.)Foreigners attending through training, research, foreigners who participate in internships and courses, public institutions
- Foreigners who apply within six months from the date of completing the graduation of higher education in Turkey. (These foreigners may be granted a one-year residence permit for a period of one year only.)
Short-term is found to be used outside of a residence permit for administration purposes, a foreign person to stay a total of 120 days over abroad in the last year or deportation for foreigners or not in cases where the presence of prohibited entry to Turkey, if it has been given it will be revoked, if expired it will not be extended.
Student Residence Permit
Student residence permits are given to foreign students who will be educated at all levels in our country. In accordance with the provisions of Article 39 of the Residence Permits Law, which will be given at the primary and secondary education level, it is given for one year from the beginning of the education to the beginning of the next academic year. (Foreigners who will be educated at the Primary and Secondary level with a family residence permit can continue their education without having to obtain a residence permit until the age of 18 years. Students who have reached the age of 18 and still continue their education at the secondary level are required to have a residence permit.) Pre-Bachelor, Bachelor, Master, Doctorate, Medical Specialisation Training (TUS), Specialist Education in Dentistry (DUS) levels of the students who will be educated in terms of legislation and the student unless otherwise requested by the student are granted a residence permit to cover the entire duration of the training. Student Residence Permit for foreign students coming to our country for education or internship within the scope of EU Education and Youth Programs (Erasmus + Programs); others will be given short-term residence permits. (TÖMER) According to Article 31 of the Law, foreign students coming to our country in order to receive Turkish education are given a Short Term Residence Permit in a manner not exceeding one (1) year and in any case at least twice (2). Students should consider this situation when obtaining a residence permit for TÖMER. Student residence permit applications are included in domestic applications. It is envisaged that student residence permit applications will be made directly from abroad in the following periods. Foreigners who apply for a residence permit in accordance with Law No. 5510 are covered by general health insurance if they make a request within 3 months of the first registration date. Applications for extension of a residence permit shall be made 60 days before the end of the residence permit period and in any case before the end of the residence permit period to the governorships (provincial security directorates). In case of failure to provide an acceptable excuse if the application is not made in time, the student is deported. Associate degree students studying in our country, undergraduate students at the end of the first year, master and doctorate students can work directly by obtaining a work permit. In the scope of Special Student, foreigners who are registered in any higher education institution in our country are given a short term residence permit provided that they document their situation. The applications for the residence permit of those who have not completed their maximum education period but who cannot graduate from the right to enter the examinations are considered within the scope of the short term residence permit.
If evidence proving that the education cannot continue or that the residence permit is being used outside of its reason for issue or that this permit was only being used as a means to stay in Turkey the “Student Residency Permit” will be cancelled ex officio by governorships.
Long Term Residence Permit
Long-term residence permit having lived uninterruptedly for eight years in Turkey, has not been receiving social assistance for the last three years, adequate and regular source of income and have a valid health insurance, creating a threat to public order and safety, immigration policy excluding foreigners deemed appropriate by the Board, be given to foreigners. In calculating the uninterrupted eight years specified in the conditions, half of the duration of the student residence permit stated in Article 38 of the law and all other residence permits are counted. Foreigners with long-term residence permits may benefit from the rights granted to Turkish nationals, without prejudice to their right to do military service, to elect and to be elected, to enter into public office and to import exempt vehicles and to exempt from the rights in respect to social security, except for special laws. In accordance with Article 45 of the Law, courtesy of resident foreigners who stay long-term health in Turkey, if located outside of compulsory education and the country of Turkey continuously for more than one-year residence permit will be cancelled with the exception of public service. In the event that the foreigner poses a serious threat to public order and security, it cannot be reapplied for the resettled residence permits. The cancellation of long-term residence permits is made after the approval of the Ministry by the governorships. For long-term residence permits cancelled, applications will be made to the consulates abroad and to the governorships in Turkey. Courtesy of eight years of uninterrupted residence in the application again must not be sought again to stay in Turkey and applications will be evaluated as a priority and will be finalised at the latest within a month.

Permission to Employ Foreign Personnel

All foreign nationals who wish to work in our country are prohibited by law without a work permit and work permits which allow foreign personnel to work legally are regulated by article 4 of Law No. 4817and Ministry of Labor.
If you want to employ a foreign staff in your workplace or home, your business or home must meet the criteria the Ministry looks for in the companies/houses that will employ foreign personnel.
1. 5 Turkish nationals are obliged to employ a work permit for each foreign personnel at the workplace. The person who will receive work permit is sought for the last 6 months of a 1-year work permit given to 5 Turkish citizens.
2. The Company’s paid-in capital must be minimum 100,000 TL. If the enterprise does not comply with this criterion, the gross sales of the last year should be 800,000 TL or the operating export should be USD $ 250,000.
3. While article 2 is not sought for Foundations and Associations, the education sector and other Turkish airline representatives are exempted from article 1 and 2.
4. The minimum capital share of the Company shareholders must be 20%, but this figure should be at least 40,000 TL.
5. When calculating the amount of salary to be paid to the personnel by the enterprise, the overlap of the personnel with the work and competence to be performed should be taken into consideration. The salary to be paid is calculated on the basis of the minimum wage applicable at the date of application and the minimum wage is 1.5 times the minimum wage.
6. The execution of professions requiring specialisation such as masseurs and SPA therapists is only permitted if the enterprise in question is at least a certified 4-star hotel or holiday village certified by the Ministry of Culture and Tourism.
7. In the roles where the tourism animation organisation companies and the entertainment sector require proficiency (animator, etc.), if the enterprise employs 10 Turkish citizens, the criteria of 5 Turkish citizens will not be sought for each foreigner.
8. While evaluating the work permits of foreign personnel who will work in the procurement of goods and services of public institutions, the criteria in articles 1 and 2 are not sought.
9. In cases where a Turkish expert cannot be found in the required qualifications or in the studies requiring high technology, articles 1 and 2 will not be sought with the approval of the General Directorate. ( Capital and Turkish citizens employment)
10. The property will be assessed if the feature is significant potential FOREIGN DIRECT INVESTMENT outside the business in foreign key personnel to work in business in Turkey by considering the number of workers in all workplaces.

(1) Provisions stipulated in special laws shall be reserved and provided that the foreigner and the employer fulfil their obligations under other laws;
- a) Turkey is a party to bilateral or multilateral agreements are exempted from the work permit,
- b) Foreigners whose permanent place of residence is abroad that will come to turkey for less than a month for scientific, cultural and artistic activities and less than four months for sportive activities,
- c) Installation of imported machinery and equipment to Turkey, maintenance and repair, receive training on the use of grant or equipment malfunctions or for the repair of vehicles in Turkey; (Amended statement: RG-22/1 / 2015-29244) from the date of entry into Turkey to exceed a total of three months in a year and the condition of incoming documents to be submitted to prove with this situation,
- d) Exported from Turkey or imported to Turkey goods and education (Amended statement: RG-22/1/2015-29244) on the use of services to more than three months within one year from the date of entry into Turkey and provided to prove with documents to be submitted to the situation of those in Turkey,
- e) Licensed to operate outside the boundaries of business tourism trade fairs and shows and similar officials in circuses as to exceed six months from the date of entry into Turkey and those who provided the documents to be submitted to prove this situation,
- f) Foreigners who come to increase their knowledge and experience for universities, public institutions and organisations by proving their status with documents not to exceed two years and limited to the duration of education,
- g) Socio-cultural and important services to Turkey in a period not exceeding six months in subjects with technological training and those reported by the relevant authorities may contribute,
- h) Foreigners who wish to come for the duration of the programs carried out by the European Union Education and Youth Programs Center (National Agency),
- i) Foreigners to work as interns in line with the scope and duration of internship programs agreed by the Ministry, the Ministries of the Interior and Foreign Affairs and the Council of Higher Education,
- j) Foreign tour operator representatives travelling to Turkey whose incumbency shall not pass eight months,
- k) The Turkey Football Federation of Youth and Sports General Directorate of demands or eligible foreign players and other athletes and coaches during the duration of their contract,
- l) According to the I / 10 Rules of the International Convention on Education, Certification and Shift Standards provided by Gemiadamları, foreign seafarers working on ships operating in and out of the cabotage line of Turkish International Ship Registry, which has received a Certificate of Conformity Approval from the relevant administration,
- m) Foreign experts assigned to projects carried out in the context Turkey-EU Financial Cooperation Program during the duration of their work are not required to obtain work permits.
If foreign architects, engineers and city planners who are subject to exemption provisions exceed the service period of one month, they should complete their academic and professional qualifications, get a work permit from the Ministry, be a temporary member of the relevant professional organisation and comply with the practices of national institutions and organisations.
Definite Work Permit :
The definite work permit is granted for a maximum of one year to work in a specific workplace or business and a specific occupation, depending on the situation in the labour market, developments in the working life, sectoral and economic conjuncture related to the employment, and the duration of the service of the foreigner or the duration of the work.
After one year legal working period; the duration of the work permit can be extended by a maximum of “two years“ to work in the same office or in the same business and in the same profession.
At the end of a three-year statutory period of work, the duration of the work permit may be extended by a maximum of, three years in order to work with the employer of his/her choice.
In accordance with Article 27 of the Law on Foreigners and International Protection No. 6458, valid work permits also replace residence permits.
Indefinite Work Permit :
Those who retain the right to a long term residence permit in accordance with Law no 6458 or those who have remained in Turkey uninterrupted for eight years or who has eight years of uninterrupted legal work while the rights of foreigners who received indefinite work permits before 11/4/2014. Foreigners who are allowed to work indefinitely benefit from the rights provided by the long-term residence permit.
In case the workplace or the workplace address of the foreigner working indefinitely changes, the Ministry shall be notified to the Ministry within fifteen days at the latest. The Ministry shall inform the relevant authorities by making necessary changes in the work permit which is indefinite according to the information and documents sent.
Independent Work Permit :
Foreigners who will work independently for at least five years for which they have resided legally and continuously in Turkey may be given an independent work permit on the condition that work creates added value in terms of economic development and job creation.
In order to be taken into consideration in the evaluation of the application for an independent work permit, the documents that prove that the activity of the foreigner shall have sufficient income for the national economy and the activity to be exercised by the foreigner shall be submitted to the Ministry of Labor and Social Security together with the application.
Foreign company partners and company owners who do not meet the requirements for an independent work permit can be granted permanent work permits.

Work Permit of Deported Foreigners
Can foreigners who have been deported enter Turkey? This question is on the mind of many foreign nationals as well as employers and relatives in Turkey. The important thing here is why the foreigner was deported.
If the foreigner was deported from our country due to involvement in infamous crime they may not re-enter Turkey until the date their entry restriction has ended, however if the person was deported due to a visa violation, which is the most common reason for the deportation of foreigners, obtaining a work permit shall lift the person’s entry restriction. In case the foreigner who is deported finds a job in our country, his/her deportation is removed with a work permit without considering the period of prohibition of entry. The visa violation fine for the extra time the person stayed in Turkey is calculated and the foreigner is not allowed to enter our country unless the required fine is paid. The work permit application must be submitted to the Ministry of Labor in Ankara following the application of the foreigner to the Turkish Embassy in his/her home country for his/her work visa. After the approval of this work permit, the foreigner must return to the Embassy the first application was made to get the visa affixed to his/her passport and may travel to Turkey however must pay any previous fines from visa violations. How are work permits extended?
As ASA Consultancy, we are at your side with our professional staff for your work permit extension requests. Pursuant to Article 5 of the relevant By-Law; work permit and time extension applications must be made primarily in an electronic environment. Within this scope, in order for the work permit or time extension applications accepted by the system to be accepted and approved by the system, your application file must be submitted to the Ministry of Labor together with the other documents specified in the annexe of the Regulation within six working days following its approval. In order to extend the duration of a work permit granted by the Ministry; the extension of the work permit must be submitted within two months of the expiry of the work permit. In case of extension of the work permit, the start date of the extended work permit is the date on which the expired work permit expires.

How to apply for work permit abroad ?
Work permit applications made outside of Turkey from the foreigner’s country of residency are categorised as work permit applications from abroad and must be first done through a Turkish Embassy in their own country. In accordance with the regulation prepared in 2016, foreign personnel must apply for a preliminary permit appointment by presenting the contract signed with the employer and other necessary documents before applying for a work visa application. On the appointment date, the documents prepared by us are accepted at the embassy as an application and the reference number to be used in Turkey for application of a work permit with the Labour and Social Security Ministry is given.
The validity period of the reference number given by the representative of the Republic of Turkey is 10 business days and during this time the application for a work permit must be done in paper to the Ministry of Labour. Otherwise, the work permit application will be rejected by the Ministry.
The examination duration of the file is 20 to 30 days, during which the result is communicated to the applicant.
In the event that the application is approved, the Ministry informs our Consulates online, and the work permit card is prepared by the Ministry and sent to your address after the foreign employee has paid the fee determined for their country to the Consulate.

Work Permit Applications Done Domestically
Applications to be made domestically; excluding residence permits for education in Turkey, applications for anyone who has received a residence permit for at least “six months” and has expired or these foreigners” employers can apply through the Labour and Social Security Ministry. In this context, the work permit issued pursuant to applications made by foreigners, are not required to get a work visa through Turkey’s foreign representations. Pursuant to Article 5 of the relevant By-Law; work permit applications have to be made in the electronic environment. In order for the work permit applications to be valid and approved by the system and approved by the system, the work permit application file must be prepared as requested by the Ministry and submitted to the Ministry in paper form. This must be done within six working days following the approval of the application, otherwise, the application is not approved by the Ministry.
